Enable Intrastate Transmission, LLC owned and operated a natural gas pipeline that crossed Indian allotted land in Anadarko, Oklahoma. A twenty-year easement for the pipeline expired in 2000. Enable failed to renew the easement but also failed to remove the pipeline. In response, roughly three-dozen individual Native American Allottees who held equitable title in the allotted land filed suit. The district court granted summary judgment to the Allottees, ruling on the basis of stipulated facts that Enable was liable for trespass. The court then enjoined the trespass, ordering Enable to remove the pipeline. Enable appealed both rulings; the Tenth Circuit affirmed in part, reversed in part and remanded for further proceedings. The Court determined the district court properly granted summary judgment to the Allottees but erred in issuing the permanent injunction. A federal district court’s decision to permanently enjoin a continuing trespass on allotted land should take into account: (1) whether an injunction is necessary to prevent “irreparable harm;” (2) whether “the threatened injury outweighs the harm that the injunction may cause” to the enjoined party; and (3) whether the injunction would “adversely affect the public interest.” The Tenth Circuit concluded that by ordering Enable to remove the pipeline on the basis of liability alone, the district court legally erred and thus abused its discretion. The district court incorporated a simplified injunction rule from Oklahoma law when it should have adhered to basic tenants of federal equity jurisprudence. South Carolina filed suit to enjoin the United States and others from terminating the construction of a mixed-oxide fuel nuclear processing facility located in the state. The Fourth Circuit held that South Carolina failed to establish standing to pursue its claims and therefore vacated the preliminary injunction imposed by the district court. In this case, South Carolina's alleged injury -- becoming the permanent repository of weapons-grade plutonium -- was too speculative to give rise to a sufficient concrete injury in fact. The court also held that South Carolina's claims failed on ripeness grounds where numerous contingent future events must occur before South Carolina becomes the permanent repository of the nuclear material. Plaintiff-Appellant DTC Energy Group, Inc., sued two of its former employees, Adam Hirschfeld and Joseph Galban, as well as one of its industry competitors, Ally Consulting, LLC, for using DTC’s trade secrets to divert business from DTC to Ally. DTC moved for a preliminary injunction based on its claims for breach of contract, breach of the duty of loyalty, misappropriation of trade secrets, and unfair competition. The district court denied the motion, finding DTC had shown a probability of irreparable harm from Hirschfeld’s ongoing solicitation of DTC clients, but that DTC could not show the ongoing solicitation violated Hirschfeld’s employment agreement. After review, the Tenth Circuit determined the district court did not abuse its discretion when denying DTC's motion for a preliminary injunction, and affirmed. View "DTC Energy Group v. Petitioner, owner of a number of electric generation resources in New England, challenged FERC's adoption of changes to the Transmission, Markets, and Services Tariff proposed by the Independent System Operator for New England (ISO-NE). The DC Circuit held that the parties' dispute may be illusory and thus remanded the record for the agency to sort out what it really means. The issue presented to the Pennsylvania Supreme Court in this appeal centered on whether producers of natural gas from certain vertical wells were subject to assessment of a yearly impact fee established by Chapter 23 of the Pennsylvania Oil and Gas Act (“Act 13”). The vertical wells that at issue used the hydraulic fracturing process ("fracking") to extract natural gas through a vertical well bore from Marcellus Shale. Specifically, the issue centered on whether an impact fee would be assessed whenever a vertical well’s production exceeded an average of 90,000 cubic feet of natural gas per day for even one month of the year, or whether the well must exceed this production threshold in every month of the year, for the fee to be imposed. After careful review, the Supreme Court concluded that, under the relevant provisions of Act 13, the impact fee would be imposed on such wells if their production exceeds 90,000 cubic feet of natural gas per day for even one month of the year, as found by the Public Utility Commission (“PUC”). The issue raised on appeal in this matter centered on a trespass claim by Plaintiffs-Appellants Marvin and Mildred Bay that Defendants-Appellees Anadarko E&P Onshore LLC and Anadarko Land Corp. (together, “Anadarko”), that through a lessee, exceeded the scope of an easement by using excessive surface land to drill for oil and gas. The district court had diversity jurisdiction over the case and entered final judgment against the Bays pursuant to Federal Rule of Civil Procedure 54(b). The Tenth Circuit was presented with an issue of whether a deed reserving mineral rights in land (and the specific right to use the surface as “convenient or necessary” to access the minerals) requires applying a different test than the one prescribed in Gerrity Oil & Gas Corp. v. Magness, 946 P.2d 913 (Colo. 1997), to evaluate whether the mineral owner’s use of land constitutes a trespass. The Court concluded it did not, and reversed and remanded for further proceedings. The Department of Water Resources (DWR) applied to the Federal Energy Regulatory Commission (FERC or Commission) to extend its federal license to operate Oroville Dam and its facilities as a hydroelectric dam (referred to as the Oroville Facilities Project, Project, Settlement Agreement or "SA"). The plaintiffs brought this action in the superior court to stay the license procedure on the premise the environmental effects of relicensing the dam concern the operation of the dam and that jurisdiction to review the matter lies in the state courts pursuant to the California Environmental Quality Act. They claimed that a CEQA document offered to support the DWR’s application to FERC failed to consider the impact of climate change on the operation of the dam for all the purposes served by the dam. The superior court dismissed the complaint on the ground that predicting the impact of climate change is speculative. The plaintiffs appealed. A federal license is required by the Federal Power Act for the construction and operation of a hydroelectric dam. The license is issued by FERC. With one relevant exception, the FPA occupies the field of licensing a hydroelectric dam and bars review in the state courts of matters subject to review by FERC. Plaintiffs did not seek federal review as required by 18 C.F.R part 4.34(i)(6)(vii)(2003). The Court of Appeal concluded it lacked jurisdiction to hear this case. Husky Ventures, Inc. (“Husky”) sued B55 Investments Ltd. (“B55”) and its president, Christopher McArthur, for breach of contract and tortious interference under Oklahoma law. In response, B55 filed counterclaims against Husky. A jury reached a verdict in Husky’s favor, awarding $4 million in compensatory damages against both B55 and McArthur and $2 million in punitive damages against just McArthur; the jury also rejected the counterclaims. In further proceedings, the district court entered a permanent injunction and a declaratory judgment in Husky’s favor. After the court entered final judgment, B55 and McArthur appealed, and moved for a new trial under Federal Rule of Civil Procedure 59(a) or, in the alternative, to certify a question of state law to the Oklahoma Supreme Court. The court denied the motion in all respects. On appeal, B55 and McArthur contended the district court erred in denying their motion for a new trial and again moved to certify a question of state law to the Oklahoma Supreme Court. In addition, they appealed the permanent injunction and declaratory judgment and argue that the district court erred in refusing to grant leave to amend the counterclaims. The Tenth Circuit dismissed B55 and McArthur’s claims relating to the motion for a new trial for lack of appellate jurisdiction and denied their motion to certify the state law question as moot. At issue was what type of reference within a chain of title is sufficient to preserve an earlier-created interest under Ohio’s Marketable Title Act, which generally allows a landowner who has an unbroken chain of title to land for a forty-year period to transfer title free of interests that existed prior to the beginning of the chain of title unless sufficient reference is made to interests within that chain of title.Landowners sought to extinguish an oil-and-gas royalty interest created in 1915. Landowners argued that a reference in a deed in their chain of title to the royalty interest, as well as the original holder of the interest, was not sufficient to preserve the interest because it did not include either the volume and page number of the record in which the interest was recorded or the date on which the interest was recorded. The court of appeals concluded that Landowners’ title remained subject to the royalty interest. The Supreme Court affirmed, holding that a reference that includes the type of interest created and to whom the interest was granted is sufficiently specific to preserve the interest in the record title. A district court may, in appropriate circumstances, issue a preliminary injunction granting a pipeline company immediate access to property that it has an established right to condemn under the Natural Gas Act. Transcontinental filed consolidated condemnation proceedings against property owners in order to obtain an easement for the construction of a natural gas pipeline. The Eleventh Circuit affirmed the district court's grant of summary judgment for Transcontinental on the issue of whether it had a right to condemn certain portions of defendants' properties under Section 7(h) of the Natural Gas Act. The court held that the district court did not err in concluding that there was no genuine issue of material fact as to whether Transcontinental held a valid certificate of public convenience and necessity; the property to be condemned was necessary for the natural-gas pipeline authorized by the certificate; and Transcontinental could not acquire the necessary easements by contract.The court also affirmed the district court's issuance of a preliminary injunction allowing Transcontinental to immediately enter defendants' properties and begin construction. The court held that the district court did not abuse its discretion in requiring Transcontinental to post a surety bond rather than a cash deposit. View "Transcontinental Gas Pipe Line Co., LLC v.
